Will prison time deter pic pirates?
While Hollywood hopes the one-year prison sentence for the "X-Men Origins: Wolverine" pirate will scare off potential copycats, the precedent-setting punishment is unlikely to dramatically affect the battle against content theft, experts say. NYer Gilberto Sanchez was sentenced Monday to a year in federal prison for uploading the 20th Century Fox pic in March 2009 -- more than one month before its theatrical release. His sentence is the longest incarceration for online theft of a single film, according to the Justice Department. "I hope Internet pirates will think twice before they upload," assistant U.S. attorney Lisa E. Feldman, who worked on the "Wolverine" case, told Variety. "Like Sanchez, they may think it gives them prestige but it could get them prison instead." Sanchez claimed that he obtained the "workprint" copy of the film -- including several unfinished effects sequences -- for $5 from a street vendor. He then uploaded it to Megaupload.com for a day before Fox had it removed. The FBI was later able to trace Sanchez's IP address. Studio viewed the 2009 upload as the most damaging incident of piracy to date, according to legal documents from the case, largely because the film hit the Web before its theatrical release. That's almost unheard of, and it contributed to the severity of the punishment. In 2003, pirated copies of "The Hulk," "Terminator 3: Rise of the Machines" and "Pirates of the Caribbean: The Curse of the Black Pearl" circulated in the U.K. before the films hit theaters, but none leaked as early as "Wolverine." Despite the severity of Monday's sentencing and its potential to encourage judges to get tough on IP theft, legal experts question just how much of a deterrent it will be. The sentence could discourage some casual users but may not dissuade others who are more opposed to restrictions on distribution of copyrighted material. And since pic pirates often act out of personal interest rather than for profit, many content thieves fit the latter description. "It should certainly act as a deterrent," said Stanford U. law professor Paul Goldstein, an expert on intellectual property law. "Whether it deters the right people is still a question." The effect of individual punishments in piracy cases can be difficult to gauge. In 1997, congress passed the No Electronic Theft Act, which allowed more criminal penalties in piracy cases and opened the door to more effective criminal prosecution. Since then, Hollywood has become more combative in its efforts to stop piracy. The MPAA is backing a controversial anti-piracy bill -- the Stop Online Piracy Act -- currently making its way through Congress. But opponents say the legislation could have unintended consequences, like censoring entire websites over small infractions. Not all of the industry's anti-piracy efforts are embraced by showbizzers. Morrison. 30 MIN.With: John "Q" Quinn, James "Murr" Murray, Joe Gatto, Sal Vulcano.Cheerful stupidity could be harder to understand of computer looks, that is about as strong an endorsement as there's for "Not practical Jokers," TruTV's latest stab at bringing in the mainly male "Jackass" crowd with absolutely juvenile comedy. Inside a twist on the hidden-camera show, four men attempt to top one another with absurd challenges, taking turns feeding among the suffering pals outlandish items to say and do, then watching the silliness that develops. When not exactly festive, it's fitfully merry. Each person in the quartet -- John "Q" Quinn, James "Murr" Murray, Joe Gatto and Sal Vulcano, a comedy troupe referred to as Tenderloins -- is alternately put into a mundane setting, and also the others, utilizing a hidden earpiece, see the things they can pressure him to complete as they interacts with naturally baffled other people and bystanders. Emperor inks deal with Ge You
YANGON -- Emperor Motion Pictures has inked a five-year, three-pic deal with top mainland Chinese thesp Ge You, and the Hong Kong shingle is expected to invest no less than $78 million into the three projects. Ge is a major star in China -- his last three pics have grossed more than $200 million at the box office in mainland China alone. "We all love watching Ge You, who is a truly remarkable actor," said EMP topper Albert Lee. "Hopefully, we will be able to see other aspects of his talent through this new collaboration." Under the terms of the deal, Ge will develop and star in each of the three projects, and may also step behind the camera as producer and director if he chooses to do so. Ge collaborated with EMP on Jiang Wen's "Let the Bullets Fly," which is the highest grossing domestic movie in China of all time, in which Ge starred opposite Jiang and Chow Yun-fat. Disney Boosts Annual Dividend By 50%
The Walt Disney Co., which has been one of the stingier media conglomerates in terms of its dividend yield, said Wednesday its board approved a 50 percent hike in its annual dividend. Disney said it will pay its shareholders 60 cents for each share they own as of Dec. 16, up from 40 cents. Disney, said CEO Bob Iger, "had a great creative, strategic and financial year in fiscal 2011 with record revenue, net income and earnings per share." Disney stock advanced 5.4 percent Wednesday to $35.85. At that price and prior to the 50 percent dividend hike, Disney stock was yielding just 1.2 percent annually, the same as News Corp. and better than Sony, but less than Viacom, Time Warner, Comcast and CBS. Disney also said Wednesday that it has scheduled its annual shareholders meeting for March 13 in Kansas City, Missouri. Box Office Report: 'Twilight: Breaking Dawn' Hits $500 Mil Worldwide in 12 Days
Courtesy of Paramount Pictures Paramount Pictures has come out swinging against a fraud lawsuit filed Tuesday by a financing entity that backed a string of high-profile movies but sued claiming the studio underreported millions of dollars in revenue in fraudulent accounting statements. Melrose 2, the NY-based entity that agreed in 2006 to back a slate of Paramount films in exchange for about a 25 percent share of revenue, argues in a lawsuit filed Tuesday that the studio has engaged in a practice of "under-reporting the revenue and overreporting the costs" attributable to 29 films co-financed by Melrose, including such hists as Mission Impossible 3, Blades of Glory and the Transformers series. "In contrast, five years after [the co-financing agreement] was signed, Melrose 2 has still not seen a dollar of profit from its $375 million investment" despite the films bringing in $7 billion in revenue, states the complaint, filed in Los Angeels Superior Court. But Paramount responds in a statement released Tuesday afternoon that the studio has played fair with its financial partner: "Paramount has complied with its obligations to Melrose 2 and has been forthcoming in the audit process. We are disappointed that these sophisticated investors would choose to file a lawsuit filled with hyperbole that ignores the true facts rather than seeing that process through to completion. The Melrose 2 investors have already received almost 90% of their investment back under the financing agreement, and a number of the films in which they participate (such as the successful Transformers 3) remain in the earliest stages of their earning potential. "While we intend to vigorously defend this lawsuit, the differences between the parties' positions are relatively modest in amount and we are confident they can be resolved in the ordinary course." The lawsuit claims potentially millions of dollars in damages and argues that Paramount has repeatedly tried to hinder the audit process on specific films, as well as charge improper expenses against its profit participation obligations. There was a ton of press coverage of the Melrose deal and other mega-budget "slate" financing arrangements back in 2006 and 2007. Wall Street money was flowing freely into Hollywood, and studios were happy to take the cash in exchange for back-end participations down the road. Then, when the economy crashed and hedge funds and other financing entities shied away from movie investments, speculation arose about whether investors would make back their money on the Hollywood deals. Melrose investors believe they've been cheated. Paramount says it has complied with the deal. It will be interesting to see how this case turns out. The suit alleges causes of action for breach of contract, breach of the covenant of good faith and fair dealing, fraud, unfair competition and declaratory relief. Read the full complaint here. ABC Cuts 'Cougar Town' Episode Order
Because of ABC"Cougar Town" ABC is yanking back on its persistence for Cougar Town. The Disney-possessed network has cut seven episodes within the third season of the Courteney Cox comedy from Bill Lawrence and Kevin Biegel, sources tell The Hollywood Reporter. Warner Bros. had no further comment but a source close to the situation indicated that the director and the studio had disagreed over budget issues. It's uncertain whether Warner Bros. will continue to develop "The Man From U.N.C.L.E.," based on the 1960s TV series starring Robert Vaughn and David McCallum as superagents Napoleon Solo and Ilya Kuryakin, operatives for the United Network Command for Law & Enforcement.

Natasha Lyonne Books An Indie Playdate
Natasha Lyonne has been set to star in Tara Subkoff’s directorial debut Playdate, an indie drama that Liz Destro is producing. It is set to begin shooting this month in Los Angeles. REVIEW: Gritty Miss Bala Shows Some Leg, and Also Shows Restraint
Miss Bala is a fairly straightforward story, told in a reasonably straightforward way: A young woman in Mexico longs to win a beauty pageant as a way of making life better for herself, her father and her younger brother. But before she can make it to the first round, she runs afoul of a group of gangsters who use her — and her alluring but unassuming beauty — as a means to their own devious ends. Miss Bala — which was made by the young Mexican director Gerardo Naranjo and written by Naranjo and Mauricio Katz — is just stylish enough, a picture that doesn’t let flash get in the way of its storytelling. It sometimes leads us down some all-too-familiar corridors — if you’ve seen one Mexican drug cartel, you’ve seen ‘em all. But there’s always something to look for in the face of Stephanie Sigman as Laura Gerrerro, the young woman who one afternoon sneaks away from her family’s modest home, a stretchy “competition” dress stashed away in the plastic bag she’s carrying, in the hopes of making it past the first cut in the Miss Baja California pageant. Laura has a partner in this relatively innocent crime, her best friend Suzu. After the two earn the OK from the pageant’s organizer to return the next day, Suzu coaxes Laura out to a nightclub to celebrate. It turns out the club is filled with American DEA agents, the target of a bunch of masked baddies who storm the place. Laura survives the ambush, but she loses track of Suzu, and when she sets out to locate her friend, the thugs — led by a wily, perversely seductive fox named Lino (Noe Hernandez) — recognize her and press her into service in their war against those meddlesome law-enforcement officials. Laura, leggy and doe-eyed, tries to elude her new friends, but they keep finding her, enlisting her for one dangerous errand after another. Lino pulls some greasy strings to make her big dream come true, but the triumph is a false one, just a necessary step in Lino’s plan to snuff out a general who’s been instrumental in the big drug crackdown. Miss Bala (the title is a play on words, translating to “Miss Bullet”) is inspired by real events, but even within its unflinching grittiness, there’s something dreamlike — or perhaps nightmarelike — about it. Naranjo keeps the action tense but understated; instead of allowing explosions and shootouts to pile up, he rations them in taut doses. There’s nothing particularly daring about Miss Bala beyond its restraint, although in the contemporary movie climate, that’s probably daring enough by itself. And Sigman never overplays, either: Her character is an innocent caught in a web of cruelty and greed, and she behaves instinctively and sometimes irrationally. Laura keeps scrambling away from her sweaty, stubbly, scarred captors, but you can see she never gives a thought to where she might possibly run to — the creeps always have a way of reeling her back in. Still, Sigman doesn’t play Laura as a shrinking naif. There’s vitality and selfless valor in the way Laura lets her fear — not just for herself, but for her family — motivate her. Sigman’s enormous eyes have the capacity to take in the horrors that surround her character; she can’t help but see them. Yet Sigman doesn’t play Laura as a character undone by lost innocence. There’s a mournful undercurrent to Miss Bala; it isn’t exactly a movie where good triumphs over evil. But somehow Laura — after being abused and misused — keeps picking herself up and walking forward. Single-minded and purposeful, she won’t stop competing in her own internal pageant, even though she knows that damned crown is hard-won.

Here's Why the Woman Suing 'Drive' Isn't Completely Crazy
A few weeks ago I wrote a piece explaining why -- based on the misleading trailers -- you probably hated 'Drive.' That said, even I'm surprised to see Michigan resident Sarah Deming take this to the next level and file a lawsuit against FilmDistrict for releasing a trailer "[promoting] the film 'Drive' as very similar to the 'Fast and Furious' or similar, series of movies." Do I feel FilmDistrict amped up the action in the trailer for 'Drive' in an effort to create a more robust box-office tally? Yes. But 'The Fast and the Furious'? What? Matt Singer over at IFC doesn't think these trailers are at all the same. I watched both trailers again, too. I'm not saying this lawsuit has any merit whatsoever (and from my zero years of law school, I'm saying that it doesn't), but, perhaps, here's why Sarah Deming became confused. It's extreme, for sure, but it's also the perfect example of an unconventional way for showrunners to engage with fans. Below, Kendall Aliment of ID-PR suggests five creative ways for showrunners to interact with viewers, and maximize their exposure in the process. 1. Stay connected all week long. Remember: Your show is only on for (at the most) 42 minutes a week, but fans need to be connected to your content during all the days in between. Ask yourself, "What can I give them that's going to keep them engrossed in the characters and interested in tuning in every week?" Fall Preview: Get scoop on your favorite returning shows 2. Put casting and creative elements into the community's hands. For example, if you're looking for a new piece of art to hang in a character's bedroom on set, post a call to action and have people send in their work.Showrunners have an amazing opportunity to crowdsource, since they're the ones who get to dictate what's going to be on the air. 3.Encourage the entire crew to participate. Sometimes it's the writers, directors and producers that have the most interesting information to share, as they are the ones creating the stories. (Gasp!) “To the extent that the public dialog about the Oscars is who threw a good party or ran a successful campaign versus the quality of the work, that’s off-point for us,” Academy COO Ric Robertson told The Hollywood Reporter. “We want people to be talking about the work.” Talk about… the work… only? Well, sure. Sounds right. But restrict the Oscar parties and schmoozefests that the awards season machine runs on? What kind of country do we live in?? I kid. Let the movies stand on their own! No more buddying up between Oscar voters and filmmakers! And most importantly, no shit-talking the competition on social media! NOW I’ve heard everything! A rundown of the new Academy restrictions: - After Oscar nominations are announced on January 24 (until Feb. 21), no receptions may be held following screenings. - During this period, Academy members (and nominees) may not attend non-screening events celebrating that year’s nominees. - Filmmakers may only participate in two Q&A panels at screenings that Academy members have been invited to. - Remember, no crap talking the other guys on Twitter or Facebook or other social media. You think the Oscars selection process gets political here? Just imagine sitting in the room when Russia’s national Oscar committee grudgingly voted for Nikita Mikalhkov’s enormous critical and commercial bomb, Burnt by the Sun 2: Citadel (Utomlyonnye solntsem 2: Predstoyanie), to become the country’s official foreign language selection. Filmmaker and committee head Vladimir Menshov so strongly opposed the pick of the $45 million flop that he’s now lobbying publicly for the film’s director to pull out of the race. Burnt by the Sun 2: Citadel is an expensive period war sequel to 1994’s Burnt by the Sun, a 1930s-set Stalinist Russia drama that won Mikalhkov the foreign language Oscar. The sequel picks up during World War II, but critics panned it for various offenses including bad acting, illogical retconning, and an inane script. With a production budget of $45 million, Burnt by the Sun 2: Citadel only made $8.2 million back at the foreign box office when it opened in the spring of 2010. (A third Burnt by the Sun is reportedly in the works.) “Even if we ignore the fact that audiences and critics hated the film, Citadel is part of a series,” Menshov said in the Moskovskiye Novosti daily, via The Hollywood Reporter. “How can anyone who is out of the context make any sense of it?” Mikalhkov has yet to oblige Menshov and withdraw from the Oscar race, but would you? Besides, terrible films wind up with Oscar nominations and wins every year. Granted, they’re usually in technical categories (Norbit, Heaven’s Gate - looking at you), not in major categories. And it’s not like Burnt by the Sun 2 has gotten past the official selection stage to the shortlist or an actual nomination, which is really unlikely now. But Menshov taking a stand against bad movies sets a noble example, and a good question; should a filmmaker decline a shot at an Oscar nod just because most everyone in the world hated their movie? And which bad Oscar nominees from the past deserve to have been pre-emptively taken out of the race on account of bad reviews and terrible returns? 'Glee': Ryan Murphy Reveals Details on 'The Glee Project' Finalists' Characters

Added Murphy, "Once we thought of that, I made the number bigger." But the two winners, Damian McGinty and Sam Larsen, will be featured with major arcs. First up is McGinty and he'll have a connection with Brittany (Heather Morris); the idea was first brought up by Murphy and company on The Glee Project. Letter From Toronto: Even Killer Elite Can't Quite Rival Emmerich's Anonymous
The Toronto Film Festival is a world away from Venice, and the difference is especially acute when you hop from one to the other: Toronto is big and glossy, while Venice is intimate and glowing — it’s like the difference between lacquer and gold leaf. But each has its own appeal, and the scale of Toronto is appealing by itself. It’s a little overwhelming but exhilarating, too. Still, my morning didn’t exactly start off with a bang: The day’s first screening, of Gary McKendry’s Killer Elite, began half an hour late, the kind of glitch that can seriously mess up an already tight morning schedule. Worse yet, the movie wasn’t all I was hoping it would be. It wasn’t even half what I was hoping it would be. Jason Statham plays a retired Navy SEAL called out of retirement — doesn’t Statham always play reluctant hit men who just want to retire to a cabin in the woods? — to rescue an old pal, Robert De Niro, who’s been kidnapped by a sheik out to avenge the murder of his sons. Clive Owen plays a member of a Special Air Service vigilante group who’s out to stop Statham and his gang. While the idea of having three fine actors in an action movie together is certainly promising, Killer Elite proves that it doesn’t really matter who you cast if the filmmaking is just more of the same old choppily edited, noisy action crap. De Niro’s character spends most of the movie out of sight, locked up in a room somewhere, though De Niro isn’t bad in the 10 or 15 minutes of screentime he’s got — he puts his crazy twinkle to good use. And he does get to fire a machine gun, which is probably a lot more fun for him than playing Pops Focker for the umpteenth time. Statham and Owen are fine, too, to the extent that they get to do anything. But I’m not sure the best way to use these two actors is to throw them into a blur of grappling, grunting, head-bashing and attempted scissor-stabbing, which is how they first come together. As we already know from movies like Croupier, The International and Children of Men, Owen has much more to offer, and Statham, who was terrific in The Bank Job, desperately needs to break out of the reluctant-action-hero mold he’s been locked into. Killer Elite is a middling entertainment — not terrible, just undistinguished, and maybe that’s worse. In contrast, Roland Emmerich’s Anonymous is, at the very least, a curiosity, one with some clever casting and a very fine performance at its core. Emmerich is usually too busy destroying the world or going back in time to cavort with woolly mammoths to give much thought to who, exactly, Shakespeare really was. But that’s exactly what he does in Anonymous, which suggests — in a highly unbelievable fashion — that the plays and poems we attribute to Shakespeare were really written by one Edward de Vere, Earl of Oxford, a minor Elizabethan poet. Well, it could be true. Emmerich treats the possibility solemnly, welcoming us into his movie with a tony intro by Derek Jacobi, who steps into a theater spotlight to deliver a semi-informative prologue in plummy tones. The whole affair is rather silly, and more than a little boring, but there are a few flashes of brilliance tucked amid Emmerich’s bid for period-picture classiness. First, there’s the inspired casting of Vanessa Redgrave and her daughter, Joely Richardson, as old and young versions of Queen Elizabeth I. Richardson, with her tumble of pale curls, looks like a living, breathing version of John Millais’ Ophelia, but tougher. Redgrave plays her version of the character as if she has become more emotionally vulnerable, not less, with age — the older Elizabeth just works harder to submerge it beneath her imperious veneer. Both performances are great fun to watch, but it’s Rhys Ifans, as the Earl of Oxford, who keeps the movie spinning. He takes dorky, grandiose dialogue and turns it into something almost — well, Shakespearean. His character has spent his life writing incredible plays and sonnets, but he’s forced to hide his identity from the public. As Ifans plays him, he’s OK with all that — it’s the personal anguish he’s suffered that really matters, and Ifans carries that bruised nobility with him every second. His voice, sonorous and always just faintly sorrowful, reminds me of that of the late, great Richard Harris. Although Harris was Irish and Ifans is Welsh, they’re linked in spirit, rapscallions who can really buckle down and surprise you with their depth and heart. I giggled at parts of Anonymous, especially when our earl’s angry, disapproving wife catches him at his desk and bellows, like Gale Sondergaard with PMS, “My God! You’re writing again!” But I never laughed at Ifans. When you look into those eyes, you could almost believe that this was the guy who wrote all those sonnets.
